Acceptance of Terms
By accessing or using the My Asian Nanny mobile application (the “App”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to all of these Terms, do not use this App.
Services Provided
My Asian Nanny provides a platform that connects users with service providers for nanny, elderly care, and postpartum nanny services (“Services”). My Asian Nanny is not the employer of any service provider. We facilitate connections between users and potential service providers through features such as in-app text, video chat, and geo-location services.
User Responsibilities
It is solely the responsibility of users to vet potential service providers. Users should perform their own due diligence by interviewing, verifying credentials, and conducting background checks as necessary before hiring anyone and inviting them into their homes. My Asian Nanny does not endorse any particular service provider and cannot be held liable for the conduct of service providers or users.
No Liability
My Asian Nanny shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from your use of the App, including, but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (even if My Asian Nanny has been advised of the possibility of such damages).
Use of Features
The App’s in-app text, video chat, and geo-location services are provided to assist users in finding and communicating with service providers. My Asian Nanny does not guarantee the availability, accuracy, completeness, reliability, or timeliness of these features.
Indemnification
You agree to indemnify, defend, and hold harmless My Asian Nanny, its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against all losses, expenses, damages, and costs, including reasonable attorneys’ fees, resulting from any violation of these Terms or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the App using your account.
Amendments
My Asian Nanny reserves the right to amend these Terms at any time and without notice. Your continued use of the App following any changes signifies that you accept and agree to the changes. It is your responsibility to review these Terms periodically.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which My Asian Nanny is headquartered, without giving effect to any principles of conflicts of law.
Severability
If any provision of these Terms is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
Entire Agreement
These Terms, together with any additional terms to which you agree when using particular elements of the App, constitute the entire agreement between you and My Asian Nanny pertaining to the use of the App and supersede all prior agreements, representations, and understandings.
Acknowledgment
By using the App, you acknowledge that you have read these Terms of Use and agree to be bound by them.
